These Terms of Service (“Terms”) govern your use of the logistics, courier, and related services (collectively, the “Services”) provided by DeliTrans, a company based in the United States, operating worldwide (referred to as “DeliTrans,” “we,” “us,” or “our”).
By accessing or using our Services, you agree to be bound by these Terms, along with our Privacy Policy. If you do not agree to all of these Terms, you may not use our Services.
1. Acceptance of Terms
By using the DeliTrans website, mobile application, or any of our physical or digital Services, you affirm that you are 18 years of age or older and legally capable of entering into this agreement. If you are using the Services on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
2. Scope of Services
DeliTrans provides e-commerce logistics, courier services, and international parcel delivery. Our Services include, but are not limited to, pickup, transportation, tracking, and delivery of shipments, both domestically within the USA and internationally.
3. User Obligations and Responsibilities
A. Accurate Information
You are responsible for providing complete and accurate information for all shipments, including sender/recipient names, addresses, contact details, package contents, and declared value. Inaccurate information may lead to delays, additional charges, or non-delivery, for which you will be solely responsible.
B. Compliance with Laws (Domestic and International)
You agree to comply with all applicable local, state, federal, and international laws, rules, and regulations, including but not limited to:
- Export/Import Regulations: You must comply with all US export and trade control laws, as well as the import laws of the destination country, including customs declarations and payment of any applicable duties, taxes, and fees.
- Prohibited Items: You warrant that your shipment does not contain any prohibited goods, hazardous materials, or items restricted by DeliTrans or by any governmental authority in the country of origin, transit, or destination. (A list of prohibited items is available on our website).
C. Packaging and Labeling
You are responsible for adequately packaging your shipment to withstand normal handling during transit and for properly labeling it as per DeliTrans guidelines.
4. Fees and Payment
A. Service Charges
You agree to pay the rates and charges for the Services you select, as quoted by DeliTrans. All quotes are estimates and may be subject to change based on the actual weight, dimensions, and nature of the shipment verified upon inspection, or due to unforeseen customs charges or duties.
B. Duties, Taxes, and Fees
For international shipments, you are primarily responsible for all customs duties, taxes, tariffs, and customs clearance fees (“D&T”) levied by the destination country. You agree that DeliTrans may pay these on your behalf and subsequently bill you. If the recipient refuses to pay the D&T, you agree to pay DeliTrans all outstanding amounts, plus any applicable administrative fees.
C. Failure to Pay
Failure to pay any charges due may result in the suspension of your account and retention of your parcels until full payment is received.
5. Tracking and Delivery
A. Tracking
We will provide tracking information for shipments; however, tracking accuracy may be limited by local carrier capabilities, particularly in international destinations.
B. Delivery Attempts
DeliTrans or its agents will make reasonable attempts to deliver the shipment. If a delivery cannot be completed, we reserve the right to return the shipment to the sender at the sender’s expense or dispose of it in a manner determined by DeliTrans.
6. Liability and Claims
A. Limitation of Liability
DeliTrans’s liability for loss, damage, misdelivery, or non-delivery is limited to the declared value of the shipment or [Insert Specific Liability Limit, e.g., $100 USD], whichever is lower, unless additional insurance is purchased. This liability limitation applies regardless of the cause of loss or damage, including negligence, except where prohibited by law.
B. Exclusions of Liability
DeliTrans is not liable for:
- Loss or damage to shipments containing Prohibited Items.
- Loss or damage caused by improper packaging.
- Consequential, indirect, incidental, or punitive damages (including loss of profits or loss of business opportunity) arising from the use or inability to use the Services.
- Delays caused by customs clearance, acts of God (force majeure), or events beyond our control (e.g., severe weather, strikes, civil unrest).
C. Claims Procedure
All claims for loss or damage must be submitted to DeliTrans in writing within [Insert Number, e.g., 30] days of the date of acceptance of the shipment, accompanied by supporting documentation (photos, proof of value, etc.). Failure to adhere to this timeframe will result in the denial of the claim.
7. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of [Insert US State, e.g., the State of New York], without regard to its conflict of law principles.
Any dispute or claim relating in any way to your use of the Services will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the “Effective Date” at the top of this page. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes.
